Acceptable Use Policy

Effective Date: 18 November 2019

HelloCrowd may receive requests from users and government authorities to disclose information about HelloCrowd’s users, including their personal data, other than in the ordinary operation and provision of services, for official legal proceedings. This data request policy (the “Policy”) outlines HelloCrowd's policies and procedures for responding to data requests with regard to HelloCrowd’s customers’ and users’ personal data, user account records, the User Data, and the Customer Data. The Policy also contains information for individuals who would like to exercise statutory rights with regard to their personal data as set forth in the Privacy Policy.

Any capitalized terms used in this Data Request Policy that are not defined will have the meaning set forth in the Customer Terms of Service, User Terms of Service or the Privacy Policy (the “Documents”). In the event of any inconsistency between the provisions of this Policy and the Documents or written agreement with Customer, as the case may be, the Documents or a written agreement shall prevail.

What data requests does HelloCrowd accept?

HelloCrowd accepts the following types of data requests:

  1. Subpoenas;
  2. Court orders;
  3. Search warrants;
  4. Legal process received from outside the United States (a Mutual Legal Assistance Treaty (MLAT) with the United States may be necessary);
  5. Requests from data protection authorities;
  6. Other forms of legal process;
  7. Preservation requests (e.g., for user account records);
  8. Emergency requests; and
  9. Requests for exercising statutory rights regarding personal data.

Requests for Customer Data by individuals

Third parties seeking access to the Customer Data should contact the Customer regarding such requests. The Customer controls the Customer Data and generally gets to decide what to do with the Customer Data. In case HelloCrowd receives a request for the Customer Data directly, it will notify the Customer and act upon written instructions of the Customer.

Requests for Customer Data and User Data by legal authorities

HelloCrowd is committed to the importance of trust and transparency for the benefit its customers and does not voluntarily provide governments with access to any data about users for surveillance purposes.

Except as expressly permitted by the Contract or in cases of emergency to avoid death or physical harm to individuals, HelloCrowd will only disclose the Customer Data and the User Data in response to valid and binding compulsory legal process. 

HelloCrowd requires (i) a search warrant issued by a court of competent jurisdiction (a federal court or a court of general criminal jurisdiction of a State authorized by the law of that State to issue search warrants) or (ii) another equivalent legal authorization to disclose the Customer Data.

Requests by data protection authorities

HelloCrowd will cooperate, on request, with EU data protection and supervisory authorities in the performance of their tasks. HelloCrowd will reply in writing to the requests submitted to it directly by the official data protection authorities of the EU Member States with regard to investigation of data breaches and HelloCrowd’s compliance with the applicable data protection laws, including the GDPR. In cases where HelloCrowd acts as a data processor and it is necessary to do so, HelloCrowd will promptly inform the respective data controller about any of such requests.

Requests by data subjects (GDPR)

HelloCrowd respects the rights of data subjects and allows them to manage their personal data. Under the GDPR, individuals located in the EU and other jurisdictions that provide statutory rights to manage personal data may contact HelloCrowd to exercise those rights. Subject to any exemptions provided by law, individuals may ask HelloCrowd to:

  • Get a copy of their personal data;
  • Rectify inaccurate personal data;
  • Get a list of purposes for which personal data is processed;
  • Move personal data to another processor;
  • Delete personal data;
  • Object and restrict processing of personal data;
  • Withdraw any provided consent; or
  • Process a complaint regarding their personal data. 

Individuals willing to exercise their rights can do so through the Platforms (if functionalities of the Platforms allow) or by contacting HelloCrowd directly (dpo@hellocrowd.net) and explaining their request in detail.

In order verify the legitimacy of the request, HelloCrowd may ask to provide an identifying piece of information in order to identify individual in HelloCrowd’s system. HelloCrowd will answer any requests regarding personal data as soon as possible but no later than 2 weeks.

In the situations when HelloCrowd acts as a data processor, HelloCrowd will promptly notify the relevant data controller about the requests received from data subjects and seek its prior authorization or further instructions to provide the requested data or perform the requested operation.

How to submit data request

All requests by courts, government agencies, or parties involved in litigation for the Customer Data and the User Data disclosures should be sent in English to support@hellocrowd.net or by post and include the following information: 

  1. Contact details of the requesting party;
  2. The relevant criminal or civil matter;
  3. A description of the specific Customer Data or User Data being requested, including the relevant Customer’s or User’s name and relevant Authorized User’s name (if applicable) and type of data sought;
  4. Applicable law under which the request is served; and
  5. Any information allowing HelloCrowd to identify the Customer Data or the User Data in question. 

Requests should be prepared and served in accordance with applicable law. All requests should be narrow and focused on the specific Customer Data or User Data sought.All requests will be construed narrowly by HelloCrowd, so please do not submit unnecessarily broad requests. If legally permitted, the Customer will be responsible for any costs arising from HelloCrowd's response to such requests.

Notice to the Customer

HelloCrowd will notify the relevant Customer before disclosing any of the Customer Data so that the Customer may seek protection from such disclosure, unless HelloCrowd is prohibited from doing so or there is a clear indication of illegal conduct or risk of harm to people or property associated with the use of such Customer Data. 

If HelloCrowd is legally prohibited from notifying Customer prior to disclosure, HelloCrowd will take reasonable steps to notify the Customer of the demand after the non-disclosure requirement expires. In addition, if HelloCrowd receives a National Security Letter with an indefinite non-disclosure requirement, HelloCrowd will initiate procedures for judicial review pursuant to 18 U.S.C. § 3511.

Domestication and international requests

HelloCrowd requires any individual issuing legal process or legal information requests (e.g., discovery requests, warrants, or subpoenas) to HelloCrowd to properly domesticate the process or request and serve HelloCrowd in a jurisdiction where it is resident or has a registered agent to accept service on its behalf. Unless otherwise permitted by applicable law, HelloCrowd does not accept legal process or requests directly from law enforcement entities outside the U.S. or Canada. Foreign law enforcement agencies should proceed through a Mutual Legal Assistance Treaty or other diplomatic or legal means to obtain data through a court where HelloCrowd is located.
